New estate fence rules around Melton

Estates around Melton don't agree on fences. One asks for Colorbond, one bans it, and one lets you choose.

Atherstone and Thornhill Park are in the City of Melton's growth suburbs rather than the old township.

Editions change, and a newer Atherstone edition may read differently. Go by the guidelines on your own title.

Fence rules in three estates in the City of Melton
EstateWhat its guidelines say
AtherstoneBetween lots, Colorbond or similar in Woodland Grey, with a 1.8 m maximum. Shale Grey is also listed for corner fences. A front fence is optional, open style, 1.2 m at most (1 m on a corner).Atherstone design guidelines, March 2021 (PDF) (opens in a new tab)
Thornhill ParkNo Colorbond or aluminium. Side and back fences are capped and lapped timber with the posts showing, standing between 1.8 m and 1.95 m. No fencing is allowed forward of the house.Thornhill Park design guidelines (PDF) (opens in a new tab)
Toolern WatersMasonry, Colorbond or timber, at least 1.8 m between lots, and no front fences. Fencing must be done no later than 30 days after your occupancy permit is issued (that's the certificate saying the house is fit to live in).Toolern Waters design guidelines (PDF) (opens in a new tab)

Council help with a fence next to a reserve

Replacing a fence that backs onto a council reserve? Melton City Council's fencing policy can pay up to half, capped at $6,000 excluding GST per request.

That cap is council's limit on its share, not what a fence costs.

  1. Check it qualifies

It covers replacing an existing fence beside council land. Repairs, a first fence at subdivision, road and drainage reserves, front boundaries and industrial lots are all excluded.

  2. Timber sets the amount

Council pays towards a standard timber fence up to 1.95 m. Choose Colorbond and the extra is yours.

  3. Two written quotes and an inspection

You send the application form with two written quotes. Council inspects the old fence before work and replies within 14 days.

  4. A private neighbour instead?

Registered owners can use council's Fencing Request Form to get the contact details for the land next door.

Council decides every request. If you're counting on council paying half, wait for its answer before you book the work.

Hills, stone walls and flood ground in Melton

The planning scheme puts the City of Melton on the Victorian Volcanic Plain, and some of its fence rules come from overlays, extra planning rules written for that landscape.

Overlays are mapped property by property. Look your address up on VicPlan before choosing a style.

Permits and disputes in Melton

For fence height, the state building rules apply here. A building surveyor or Melton City Council can tell you whether yours needs a building permit.

Planning permits through VicSmart
When a front fence in a residential zone, or a fence in an overlay, needs a planning permit, it can go through VicSmart. That's council's quick-track process, with a 10 business day target.Source: Melton City Council: VicSmart (opens in a new tab)
The Toolern growth area
South of the township, around Cobblebank and Weir Views, a fence closer than 3 m to the street needs no planning permit if it stays under the state's height limit for front fences. A building surveyor can give you that limit for your street. This area is separate from Toolern Vale.Source: Melton Planning Scheme: Toolern growth area zone (UGZ3) (opens in a new tab)
Disagreements
Council doesn't settle fence disputes. The Dispute Settlement Centre of Victoria handles those, on 1300 372 888.

Usually not for an ordinary back or side fence. State building rules set the height limits, and an overlay or heritage listing may mean planning approval as well. A building surveyor or council can confirm it for your address.

Whatever your guidelines allow. Estates near Melton differ: Atherstone wants Woodland Grey Colorbond, while Thornhill Park doesn't allow it at all.

Only when you're replacing a fence next to a council reserve or other council-owned land. Council pays up to half of a standard timber fence, capped at $6,000 excluding GST, after it has inspected the old one.

Registered owners can ask Melton City Council through its Fencing Request Form. Once you've made contact, the usual rule is that you each pay half of a basic fence that suits the area, such as 1.8 m timber palings.

No. Toolern Waters' guidelines don't permit front fences. Between lots, the fence must stand at least 1800 mm tall, measured from natural ground. It has to go in within 30 days once the occupancy permit is issued. Those guidelines stop applying five years after settlement.

Yes. An overlay around those volcanic hills needs a permit for most fences, though open farm styles 1.8 m tall or less are exempt.
